Terms
All orders are shipped C.O.D. unless payment is received with your order or other
arrangements are made. Visa and MasterCard are accepted.
Shipping
All merchandise F.O.B. Otterbein, IN. Unless specified, all shipments will be sent by
the most economical method of transportation.
Custom Orders
All cars and custom work orders require 50% down and 50% upon delivery.
Claims
Claims for damages, open or concealed, are to be made to freight forwarder. Claims for
shortage must be made within five days of receipt of order.
Returns
A request must be made before return of any merchandise. Special parts are
non-returnable. All returns are subject to a 15% handling charge and all freight must be
prepaid.
Warranty
The goods and services are for the purpose of racing only, an inherently dangerous
activity and McKinney Corp. makes no representations or warranties in connection with the
use of the goods and/or services and/or goods upon which services have been performed or
their safety, and expressly disclaims all implied warranties, including the WARRANTY OF
MERCHANTABILITY or the WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.
The customer hereby releases and agrees to hold harmless and indemnify McKinney Corp.
for any harm, damage, injury or other loss or claim therefore to the customer, McKinney
Corp. or any other persons, from any and all incidents relating to the use of any goods
and/or services purchased from McKinney Corp. and/or goods upon which services have been
performed by McKinney Corp.
The remedy under any warranty which is not hereby effectively disclaimed is limited to
repair or replacement of defective parts and specifically excludes all incidental or
consequential damages. There are no warranties whatsoever as to future performance.
